Please read these Terms and Conditions ("Terms") carefully before using the PomodoroFocus mobile application ("App"). By accessing or using the App, you agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS

By creating an account or using PomodoroFocus, you confirm that:
You are at least 13 years of age (or the minimum age in your jurisdiction).
You have read, understood, and agree to these Terms and our Privacy Policy.
If you are under 18, you have obtained parental or guardian consent.
If you do not agree, you must stop using the App immediately.

2. ACCOUNT REGISTRATION

Account Creation:
You must provide accurate, current, and complete information during registration.
You are responsible for maintaining the security of your account credentials.
You must not share your account with others or allow unauthorized access.
Account Termination:
You may delete your account at any time through the App settings or by contacting pomodorofocusapp@gmail.com.
We reserve the right to suspend or terminate accounts that violate these Terms.

3. SUBSCRIPTIONS AND PAYMENTS

Free and Premium Features:
The App offers free features and optional premium subscriptions.
Premium subscriptions are processed through the Apple App Store or Google Play Store.
Billing:
Subscription fees are charged at the start of each billing cycle (monthly or yearly).
All payments are non-refundable except as required by law or App Store/Play Store policies.
Subscriptions automatically renew unless canceled at least 24 hours before the renewal date.
Cancellation:
You may cancel your subscription at any time through your App Store or Google Play account settings.
Cancellation takes effect at the end of the current billing period.
No partial refunds for unused time.
Price Changes:
We may change subscription prices with 30 days' notice.
Continued use after price changes constitutes acceptance.

4. USE OF THE APP

Permitted Use:
Use the App for personal, non-commercial purposes only.
Track your focus sessions, compete with friends, and access productivity features.
Prohibited Activities:
You must NOT:
Use the App for any illegal or unauthorized purpose.
Attempt to hack, reverse engineer, or disrupt the App's functionality.
Use automated scripts, bots, or tools to manipulate session data or challenge results.
Harass, abuse, or harm other users.
Upload viruses, malware, or harmful content.
Create fake accounts or impersonate others.
Cheat in challenges by falsifying session data.
Sell, resell, or commercially exploit the App without written permission.
Consequences:
Violation of these Terms may result in immediate account suspension or termination without refund.

5. INTELLECTUAL PROPERTY

Ownership:
All content, features, design, code, trademarks, and logos in the App are owned by PomodoroFocus or its licensors.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal use only.
User Content:
You retain ownership of any data you create (session logs, tags, challenge data).
By using the App, you grant us a license to store, process, and display your data to provide App services.
We do not claim ownership of your productivity data.
Restrictions:
You may not copy, modify, distribute, sell, or create derivative works from the App.

6. USER-GENERATED CONTENT

Your Responsibility:
You are solely responsible for any content you create or share (challenge names, session tags, profile information).
Content must not violate laws, infringe rights, or contain harmful material.
Our Rights:
We reserve the right to remove any content that violates these Terms.
We are not responsible for content created by users.

7. CHALLENGES AND COMPETITIONS

Fair Play:
Challenges are intended for friendly competition and motivation.
Cheating, manipulating timers, or falsifying data is strictly prohibited.
We reserve the right to disqualify participants or remove challenges that violate fair play.
No Guarantees:
We do not guarantee uninterrupted access to challenge features.
Technical issues may affect challenge results; we are not liable for data loss or errors.

8. DISCLAIMERS AND LIMITATIONS OF LIABILITY

"AS IS" Basis:
The App is provided "as is" and "as available" without warranties of any kind, express or implied.
We do not guarantee that the App will be error-free, secure, or uninterrupted.
No Liability for:
Loss of data, productivity sessions, or account information.
Technical failures, server downtime, or third-party service disruptions.
Damages arising from your use or inability to use the App.
Disputes between users in challenges or competitions.
Limitation of Liability:
To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for premium subscriptions in the 12 months prior to the claim.

9. INDEMNIFICATION

You agree to indemnify and hold harmless PomodoroFocus, its affiliates, and employees from any claims, damages, losses, or expenses arising from:
Your violation of these Terms.
Your misuse of the App.
Your infringement of third-party rights.

10. THIRD-PARTY SERVICES Integration:

The App may integrate with third-party services (Apple App Store, Google Play, Firebase, etc.).
Use of third-party services is subject to their own terms and policies.
We are not responsible for third-party service failures or changes.

11. PRIVACY

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

12. TERMINATION

By You:
You may stop using the App and delete your account at any time.
By Us:
We may suspend or terminate your access if you violate these Terms.
We may discontinue the App at any time with reasonable notice.
Effect of Termination:
Upon termination, your right to use the App ceases immediately.
We may delete your account data in accordance with our data retention policies.
Paid subscriptions are non-refundable upon termination for cause.

13. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of England and Wales.

14. DISPUTE RESOLUTION

Informal Resolution:
Before filing a claim, you agree to contact us at pomodorofocusapp@gmail.com to resolve the issue informally.
Arbitration (Optional):
If required by your jurisdiction, disputes may be resolved through binding arbitration rather than court proceedings.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time. Changes will be effective immediately upon posting in the App or on our website. Continued use of the App after changes constitutes acceptance of the new Terms.
Notification:
We will notify users of material changes via email or in-app notification.

16. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PomodoroFocus regarding your use of the App.
